Patrick M. Torre is a Patent Attorney in the Intellectual Property & Technology Service Group. His practice focuses on intellectual property protection strategy, including counseling clients on infringement, validity, and patentability, patent drafting, prosecution and appellate proceedings, trademark prosecution, copyright, trade secrets and transfer, and licensing of intellectual property. Pat brings a strong scientific background to his practice, including lab research experience in the areas of nutrition, immunology, biotechnology, and life sciences.

USPTO Issues Enablement Guidelines Following Amgen v. Sanofi
On January 10, 2024, the United States Patent and Trademark Office (USPTO) released Guidelines for Assessing Enablement in Utility Applications and Patents in View of the Supreme Court Decision in Amgen Inc. et al. v. Sanofi et al. The Guidelines are intended to inform U.S. patent examiners and the public about the process to be followed when assessing whether a claim satisfies the enablement requirement under 35 U.S.C. 112(a), after the U.S. Supreme Court’s holding in Amgen v. Trademark Law Developments in the Metaverse
The Metaverse (or “Web 3.0”) provides varying levels of access to three-dimensional environments for various decentralized activities such as gaming, commerce, social media, dissemination of authenticated digital assets such as non-fungible tokens (NFTs) and cryptocurrency, and others. Participants can engage in any number of virtual reality activities and transactions with others at any conceivable virtual location, whether based in reality or in fantasy. Not surprisingly, trademark law has now reached the Metaverse.

Intellectual Property in the Metaverse
The Metaverse, often characterized as the next level in the evolution of the Internet, is intended to be a virtual-reality, three-dimensional environment where users are able to interact meaningfully with not only other users but with the virtual environment itself. Mark Zuckerberg, the founder of Facebook (re-branded as Meta) has characterized the Metaverse as “an embodied internet where you’re in the experience, not just looking at it.”
