- Formula for a Project Train Wreck: Incomplete Information + Inadequate Communication X Ineffective Management = Expensive but Avoidable Litigation: A panel of construction attorneys and structural steel experts who recently litigated a case involving a complex urban project will discuss actions taken by the Owner, A/E and CM that dramatically increased the steel fabricator/erector’s costs and led to expensive litigation. The panel will discuss evolution of a complex, partially-delegated design on a fast track project, the Owner’s mismanagement of the A/E, the CM’s ineffective handling of project communications/logistics, the fabricator/erector’s reaction, how compliance with the AISC Code of Standard Practice could have prevented the litigation; and the relevance of the CoSP in evaluating the performance of all parties.
