Stites & Harbison counsels institutional investors with respect to secured and unsecured debt private placements, mezzanine financings, cross-border transactions, asset-backed transactions utilizing trust structures, credit tenant loans, project financings, loan participations, credit enhancement facilities, aircraft lending and securitization of various types.
The firm also assists investors in their use of derivatives and other asset/liability management strategies, including interest rate swap agreements.
Attorneys in the firm have represented insurance companies in establishing and maintaining investment policies and procedures required to satisfy state insurance laws and regulations. The firm monitors insurance regulatory matters and represents insureds before insurance departments in a number of states in connection with compliance issues, market conduct and financial examinations, approval of contracts, agent licensing matters, statutory investment capabilities and obtaining certificates of authority.
Stites & Harbison currently represents the liquidator in one of the largest insurance company insolvencies in the United States. The firm has been, and continues to be, instrumental in effecting an expeditious liquidation of this major insurance company and has handled a wide variety of matters associated with this endeavor.
